This Release of Liability, Assumption of Risk, and Arbitration Agreement ("Agreement") is entered into by and between [Your Name or Legal Entity] ("Participant") and Vitality Injury & Wellness LLC, doing business as Vitality Nerve Relief ("Company"). By purchasing and using any products provided by Company, including but not limited to Rebuilder products ("Products"), Participant agrees to the terms and conditions outlined in this Agreement.

1. Assumption of Risk: Participant acknowledges and understands that the use of third-party products, including Rebuilder products, involves inherent risks, including but not limited to the risk of malfunction, improper use, and faulty product. Participant acknowledges that Company is not responsible for any injury, harm, or damage that may result from the malfunction of third-party products, improper use of Products, or use of faulty Products.

2. Outsourced Third-Party Products: Participant acknowledges and understands that Rebuilder products are manufactured by a third-party company that is outsourced by Company. These products are not stored or held in the Company's facilities. Company is not responsible for the manufacturing, quality control, or distribution of Rebuilder products.

3. Prescription and Intended Use: Participant acknowledges that Rebuilder products are prescribed and intended for use by individuals as determined by qualified medical professionals. Participant agrees to use the Products only as prescribed by their healthcare provider. Participant further acknowledges that Company is not responsible for any injuries or harm that may result from the unintended use of Products by individuals for whom the Product was not prescribed.

4. Waiver of Rights to Sue: By purchasing and using the Products, Participant voluntarily waives any and all rights to bring forth a lawsuit or claim against Company, its employees, agents, affiliates, successors, or assigns, for any injuries, harm, or damages arising from the use of the Products.

5. Binding Arbitration: Participant agrees that any dispute, claim, or controversy arising out of or relating to the purchase or use of the Products, including any alleged malpractice, shall be resolved exclusively through binding arbitration. The arbitration shall be conducted in accordance with the rules of a recognized arbitration organization mutually agreed upon by both parties. The arbitration award shall be final and binding, and judgment upon the award may be entered in any court of competent jurisdiction.

6. Severability: If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

7. Entire Agreement: This Agreement constitutes the entire understanding between Participant and Company regarding the subject matter herein and supersedes all prior agreements, understandings, and negotiations, whether oral or written.

Participant Signature: By purchasing the Products provided by Company, Participant acknowledges that they have read and understood this Agreement and agree to be bound by its terms and conditions.
